Refusals are very much still in play. In DWI law today, there is no more hotly debated topic than how to defend a DWI refusal case in the aftermath of recent decisions that upended the process.
This seminar - aimed at defense attorneys - analyzes the ins-and-outs of defending a client charged with refusal in an Alcotest case. Refusals can occur for a myriad of different reasons - some due to the behavior of the machine, some due to the behavior of the defendant or police officer, and often a mixture of all of the above.
